The upstairs owner didn't want to pay the water damage caused by his washer malfunction, what can I do?

I filed a law suit in small claim court. The problem is that the sheriff had trouble to deliver the summon, he was hiding when sheriff knocked at his door. Don't worry. If the person is obviously living there the courts will be able to handle it even if he tries to hide from the summons. If you are able to talk to the sheriff or a judge about these matters simply state that you know he's still there (maybe can hear him up there, etc). Believe me, something will be done. If not, everyone would simply hide in their apartments and never answer the door. =) Good luck on the SC suit
What a jerk he is! Well, he can't hide forever. It's a shame he is doing this and wasting everyone's time. I guess just try to find out his schedule, and his work address. Anyone over 18 years old can serve the summons (I believe, in most jurisdictions). So maybe you can have a friend catch up with this loser. Good luck!
Ask the court registry people if/when you might hire a private process server and whether they are familiar with any. No idea what it costs but probably less than waiting for sherriff.

You are doing what you can. This guy hiding from the summons just looks worse for him. He can't hide forever.
find out where he works and get them to summon him there.
